1. Service Description

LendingSavant provides a marketplace platform that connects small business owners with lending sources. By using our Site and Services, you agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use our Services. You represent that all information you provide is accurate and complete.

3. Use License

We grant you a limited, non-exclusive license to access and use the Site for your personal, non-commercial use. You may not reproduce, distribute, or transmit any content without our written permission.

4. User Obligations

You agree not to:

• Provide false or misleading information
• Violate any laws or regulations
• Harass or abuse other users
• Attempt to access unauthorized areas
• Reverse engineer or attempt to gain unauthorized access to our systems

5. Indemnification

You agree to indemnify and hold harmless LendingSavant, our officers, directors, employees, and agents from losses, costs, liabilities, and expenses, including reasonable attorneys' fees, arising from:

• Your use of the Site or Services
• Your violation of these Terms
• Your infringement of any third-party rights
• False or inaccurate information you provide

6. Dispute Resolution

You and LendingSavant agree that either party may elect to resolve any dispute through binding arbitration instead of court.

7. Intellectual Property

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, artwork, and code on the Site (the "Content"), including design, structure, coordination, selection, look and feel, and arrangement, are owned by or licensed to SBL Capital LLC and are protected by law. Unauthorized use is at your own risk and we may enforce our rights.

8. Limitation of Liability

To the fullest extent permitted by law, LendingSavant shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Site or Services.

9. Termination

These Terms are effective when you first use the Site or Services and remain in effect until terminated. We may suspend or terminate your access at any time, with or without notice, for any reason. We may retain account information as needed to comply with legal and regulatory requirements. If your access is suspended for breach, all fees paid are nonrefundable and outstanding amounts become due immediately. You may terminate your account by following the "Cancellations" instructions in your account or by contacting hello@lendingsavant.com. Sections 10 and 11 survive termination.

10. SMS/Text Message Communications

By opting in to a LendingSavant text program, you agree to these Terms, including arbitration and the class action waiver. You authorize us to use autodialer or non-autodialer technology to send texts to the number you provided. Marketing content may be included. You do not have to opt in as a condition of purchase. For help, reply HELP or contact hello@lendingsavant.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy.

11. Compliance with Laws

You agree to comply with all applicable federal, state, and local laws and regulations in your use of the Site and Services.

12. Changes to Terms

We may update these Terms at any time. Your continued use of the Site after changes indicates your acceptance of the updated Terms.
